§1. General provisions
These Terms of Service set out the rules for using the pol-med.tech website (the "Site") operated by Pol-Med Sp. z o.o., with its registered office at ul. Leśna 38, 86-031 Osielsko, Poland, NIP 9671167341, REGON 093140846, BDO 000638650 (the "Company" or "Provider").
These Terms are made available free of charge in a manner that allows them to be retrieved, reproduced, and stored continuously. Use of the Site constitutes acceptance of these Terms in their current form.
Matters not regulated by these Terms are governed by the laws of the Republic of Poland, in particular the Civil Code of 23 April 1964, the Act of 18 July 2002 on Providing Services by Electronic Means, and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
§2. Definitions
"User" means a natural person, legal entity, or organizational unit without legal personality using the Site for professional or business purposes. The Site is addressed to entities conducting business activity — it is not directed at consumers within the meaning of Polish law.
"Service" means an electronic service made available by the Company through the Site, including: presentation of commercial offerings, contact forms, informational materials, and downloadable technical documentation.
"Inquiry" means a message sent by the User via the contact form or the Company's email address with the intent of obtaining commercial information or initiating contract negotiations.
§3. Scope of services
The Company provides the following services electronically and free of charge: making informational content about its offering available (UCO oils, educational stations, industrial tools), enabling the submission of inquiries, and access to publicly available technical documentation.
Paid agreements (such as UCO collection contracts, equipment supply contracts, or service contracts) are concluded outside the Site through individual negotiations and the signing of a separate agreement in written or documented form.
The Site is not an online store within the meaning of consumer protection law. Prices are not presented on the Site — commercial information is provided individually, upon request, due to the B2B nature of the offering and the dependence of terms on quality, volume, and contract specifics.
§4. Technical requirements
Use of the Site requires: a current-version web browser supporting HTML5 and CSS3 standards, enabled JavaScript, and Internet access. The Site is responsive and supports both desktop and mobile devices.
The Company makes reasonable efforts to keep the Site continuously available but does not guarantee uninterrupted availability. The Provider reserves the right to schedule temporary interruptions for technical reasons, in particular for maintenance of the hosting infrastructure.
§5. User rights and obligations
The User agrees to use the Site in accordance with applicable law, good practice, and these Terms. Providing unlawful content is prohibited, in particular: spam, content infringing the rights of third parties, or content containing malicious software.
By sending an Inquiry, the User represents that the data provided is accurate and that they are authorised to represent the entity on whose behalf the Inquiry is submitted. The Company is entitled to verify such data before providing a commercial response.
The User may discontinue using the Site at any time. Withdrawal of consent to the processing of personal data is governed by the Privacy Policy.
§6. Intellectual property
All content published on the Site — including texts, graphics, photographs, audiovisual materials, layout, trademarks, and software — is subject to copyright held by the Company or by third parties with whom the Company has entered into appropriate licensing agreements. Such content is protected under Polish copyright law of 4 February 1994.
Copying, modifying, distributing, or otherwise using the Site's content beyond fair personal use requires prior written consent from the Company. Downloading publicly available technical and commercial documentation for evaluation purposes in tender procedures is permitted.
§7. Liability
The Company is not liable for interruptions to the Site arising from technical reasons beyond its control (force majeure, hosting provider failures, third-party actions). Liability of the Company toward Users who are entrepreneurs is limited to actual damage, excluding lost profits, to the extent permitted by law.
Content published on the Site is informational in nature and does not constitute an offer within the meaning of Article 66 § 1 of the Polish Civil Code. Binding obligations of the Company arise solely from individually signed contracts.
Information about funding programmes (FERS, KPO-BCU, Erasmus+ CoVE, KFS) is provided as supporting reference only. The Company is neither a funding consultant nor a programme operator — binding interpretation of programme conditions is made by the relevant operator. Users should verify the current state of any programme with its operator.
§8. Complaints
Complaints regarding the operation of the Site should be sent to biuro@pol-med.tech. The complaint should include the User's contact details and a description of the issue, including the date and time of occurrence and the URL of the affected page.
The Company processes complaints within 14 business days of receiving the complete report. In cases requiring additional diagnosis, this period may be extended — the User will be notified accordingly.
Complaints concerning the performance of contracts concluded outside the Site (UCO collection, equipment supply, service contracts) are governed by those contracts and by the warranty provisions of the Polish Civil Code.
§9. Governing law and jurisdiction
Matters not regulated by these Terms are governed by Polish law. Disputes arising from the use of the Site that cannot be resolved amicably are settled by the common court having jurisdiction over the Company's registered office, unless mandatory provisions of law require otherwise.
The Company reserves the right to amend these Terms to the extent justified by changes in law, modifications to the scope of Services, or technical considerations. Amendments take effect on the date the new version is published on the Site. The current effective date is shown at the top of these Terms.
